Nosler's legal department will not allow them to respond.  ;D

The unfired Nosler round on the left in your photo shows the primer overly flattened like mentioned. If this was not caused by chambering in the rifle, it was caused by primer seating. If it was caused in the original production loading, it’s likely an issue with the cases. The primer pocket is too shallow. The primer bottomed out too soon when seated and the seater flattened it excessively. The primer cup is stressed and thinned. When struck by the firing pin it could not stretch enough to form the usual dent.

Good luck.

This is my best guess as well.

What's the batch number?

No batch #, shooting dogs in Colorado now. It’s 35 degrees warmer than when I left home.

I will contact Nosler next week and let you guys know the outcome. I went thru about 200 rounds of the Fioochi today with no problems!

I just found a reply from Nosler asking for a picture of the box the ammo came in.  I sent that along with the picture of the pierced and unshot rounds.

Things are moving along, they asked for my address to send me a shipping label to return the bad ammo. I assume after they receive them they will replace or refund?

That's what I would be expecting - most likely replacement when they get a look at those primers. So there was no lot number on the boxes? Some companies stamp it on the inside of the box. Highly unusual in the ammo industry, if no number anywhere.
Come and take it.

I went and looked at some of my Nosler 223 that I bought in bulk. They are packaged by 50 count in plastic ammo boxes.I couldn't find a lot number anywhere. That's why I wondered what the lot number was on Black Bear's ammo.

Nosler never replied to what the problem was with the primers in this ammo and I actually would’ve been surprised if they did. They no longer load a 40 gr BT, but are going to replace it with the 55 gr BT in .223. Can’t ask for much more in customer service.

I have shot a lot of their 22 Hornet,223,and 222 Rem Mag.A little bit of 222 Rem.Never any trouble. Most of the 223 I have bought was blemished in some way or at least sold as blems.

Their ASP 45ACP has been good too.About half and half on blem vs not blemished.Never any trouble.

I'm guessing this batch of 223 had some problem that slipped by.Maybe not even their fault.Could have been the primer maker.I guess we'll never know.At least you'll get what you are out replaced.Maybe more for your trouble.Let us know

Hopefully you get replacement rounds soon, Probably just a small quantity made it out the door, thus, no recall. This kind of thing can happen from time to time to any manufacturer, just that inspectors usually catch it before it's on the trucks. They missed this batch, so not surprisingly, they don't want to talk about it. As long as you get proper replacements, all good.
Come and take it.
